We are a digital real estate advertising, marketing and solution provider platform & loan syndication platform connecting people specially Non Resident Indians (NRIs) having interest in real estate in India.
2.IF YOU DO NOT AGREE WITH THE TERMS OF USE, PLEASE DO NOT ACCESS THIS PLATFORM FOR ANY SERVICES.⦁ This document is an electronic record under the provisions of the Information Technology Act, 2000 and Rules framed there under (as applicable or amended from time to time). These ‘Terms of Use’ constitute an electronic record within the meaning of the applicable law. This electronic record is generated by a computer system and does not require any physical or digital signatures.
⦁ This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and User agreement for access or usages of the website.
⦁ All intellectual property which is in relation to this Platform is owned by and vests in Connecting NRIs Private Limited (hereinafter referred to as “Connecting NRIs”).
⦁ This Platform is entitled to assign this Agreement, and all rights and obligations hereunder, to a successor to all or any of its assets, whether by sale, merger or otherwise. These terms shall be binding upon and shall inure to the benefit of the parties hereto and their respective representatives, heirs, administrators, successors and permitted assigns except as otherwise provided herein.
⦁ This Platform reserves the right to update, change, modify, add or remove the terms, conditions and notices of the Agreement without any prior notice to you. It is your responsibility to periodically review the most current version of the Agreement as your continued use of this Platform signifies your acceptance of any changed terms. As long as you comply with these Terms & conditions, we grant you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform.

Eligibility (User & Service Provider)
You confirm that you are of legal age i.e., 18 years to form a legally binding contract with Connecting NRIs and are not a person barred, from availing the services offered by Connecting NRIs under the laws as applicable in India.
Connecting NRIs requires registration for those who participate in a variety of its services. When you authenticate your email or mobile number for using any services and register with us or post any content/ query/ information, you accept the following terms and conditions:a) You agree to provide true, accurate, current and complete information.
b) If Connecting NRIshas reasonable grounds to suspect that any user’s information is false, inaccurate, not current or incomplete, company may suspend or terminate that user’s account and prohibit any and all current or future use of the Connecting NRIs sites (or any portion thereof) by that user other than as expressly provided herein.
c) Each user is wholly responsible for maintaining the confidentiality of account login and password information and for all activities occurring there under. Connecting NRIscannot and will not be liable for any loss or damage arising from a user’s failure to comply with this section, including any loss or damage arising from any user’s failure to: (1) immediately notify Connecting NRIs of any unauthorized use of his or her password or account or any other breach of security; and (2) ensure that he or she exits from his or her account at the end of each session.
d) You hereby unconditionally authorize / approve Connecting NRIs to reserve the right to publish any and all information provided by you, except email address and password to authenticate the user.

Representations and Warranties by you
By registering and/or listing any properties on our Website and / or Mobile App, you represent and warrant that:
(a)         you have all rights to list the said properties on the Website and / or Mobile App, and by doing so, you are not violating or infringing upon the rights (including the intellectual property rights) of any other person and any applicable laws;
(b)        You are complying with all the regulatory requirements including the provisions of Real Estate (Regulation and Development) Act 2016 in regard to the services / products being offered via this platform and the listings / advertisements posted on this platform;
(c)         all the details of the properties listed on the Platform are current, up-to-date and accurate, including the location, property specifications and price; and
(d)        by listing the properties on the Website and / or Mobile App, you are granting all such rights to Connecting NRIs to authorize Connecting NRIs to use and/or share such listing details in any manner, including on any other websites, platforms etc. of Connecting NRIs or any associate or third party;
Recognizing you as a Connecting NRIsuser
For posting on our website/ mobile app, you must login with your login email and password or alternatively use Connecting NRIs services with your registered email or mobile number. At the time of login, you will have the option to instruct the site to remember you so when you come back the next time to use this Platform, you would not have to login with your email and password.

You are advised to change your login password at regular intervals. You are solely responsible for actions taken under your password, and should not disclose it to anyone else. You cannot use your password for any unauthorized purpose. Connecting NRIs shall neither be responsible nor liable for your non-compliance with the terms of password change.

Accessing and changing your account information
You can review the personal information you provided us and make any desired changes to the information, or to the settings for your account on this Platform, at any time by logging in to your account and editing the information on your profile page. You can also close your account through this Platform by sending your request with your login email address. Your request will be processed within 7 business days.

Optional profile information
Once you provide the basic information to create an account, you will have the opportunity to provide additional information describing your property address, postal code, brief description of property etc. Provision of this additional information beyond what is required at registration is entirely optional but very helpful for the business associates to find buyers/ tenants for the property.

Internet communication protocol information
The communication standards of the Internet industry transmit the URL of the website from which you visit this Platform, the IP address of your computer, the IP address of your ISP, various attributes of your computer such as operating system, resolution and browser software and the date and time of your various requests for pages on this Platform. Connecting NRIs file logging system automatically logs all of this information in its log files for its analysis.
Disclaimers related to completeness and authenticity of the content / listings
⦁ The user should conduct checks and establish authenticity of any property, or project, its title, built up area, suitability for buying / renting in a form and manner deemed appropriate at his or her cost.
⦁ Connecting NRIs being an advertising platform does not and cannot validate the authenticity of content in its Services. A lot of content is uploaded by the advertiser and we do not filter or verify the same. If a complaint is made, we will take remedial measures.
⦁ Certain points to bear in mind:
⦁ Conduct a comprehensive check of ownership to verify owners’ / landlords’ credentials.
⦁ Visit the project site/property personally, to ensure that the seller’s / landlord’s claim is genuine and that the property is not an ‘imaginary’ one.
⦁ Beware of false title documents. Loans may have been secured against properties that may be disputed or have remained vacant for long.
⦁ We strongly recommend that proper due diligence on the property is conducted prior to entering into a transaction related to a real estate.
⦁ It should be independently ensured by the User whether the seller is complying with the provisions of Real Estate (Regulation and Development) Act 2016 and its applicability to the relevant property or project.
⦁ While reasonable efforts are being made to ensure the meaningful information being displayed and the same being asked to be updated on regular intervals, there is a possibility that the information displayed may not be current and complete;
⦁ The pictures / photos shown here may include artist’s impression of the Project. The actual properties may vary from such representations;
⦁ Users should verify the completeness and accuracy of all such information from the RERA website, as may be applicable, of respective States where the Project is registered. Connecting NRIs does not, by any means, verify, validate, endorse or promote the compliance of a specific Project with the RERA regulations. Please make sure you verify all the details independently from the RERA website before making any decision in relation to the purchase of the properties.
There is also a lot of information displayed on the platform which is neither an advertisement/ listing and is collated by our research team from the publicly available information and is meant to be a tool for the Users’ own research and awareness about real estate market. While reasonable efforts are being made to ensure the completeness of such information being displayed here and the same being updated on regular intervals by our research team, there is a possibility that the information displayed is not current and complete. This information shall in no way be considered as an advertisement or offer to sale from Connecting NRIs. Connecting NRIs shall neither be responsible nor liable for any inaccuracy in the information provided here and therefore the Users are requested to independently validate the information from the respective developers before making their decision for purchase of properties. Connecting NRIs, its directors, employees, agents and other representatives shall not be liable for any action taken, cost / expenses / losses incurred, by you, based on the information given on the portal.
Terms and Conditions applicable on user generated Content

The User viewing the content on Connecting NRIs agrees to the following:
⦁ Content does not belong to Connecting NRIs and has been independently provided by other Users like property sellers.
⦁ Connecting NRIs is only providing a platform to the users to showcase their properties and therefore the respective Users alone shall be legally responsible for their content. Connecting NRIs has no control over the content and assume no responsibility for it.
⦁ Any use or reliance on any Content or materials posted by any other user on Connecting NRIs is at the user’s own risk. Connecting NRIs does not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any user generated Content posted on its website.
⦁ The User understands that the Content might be offensive, harmful, inaccurate, otherwise inappropriate, or in some cases, it might have been mis-labelled or otherwise deceptive.
⦁ If the User notices any Content that he believes is in violation of the law or is inappropriate then he can report it to us and we shall take appropriate action within the best possible time.

The User posting the content on Connecting NRIs agrees to the following:
⦁ We have ensured that the Content does not violate any law or anyone’s intellectual property rights. Besides, we also guarantee that the Content does not display anything objectionable like nudity, violence, harassment, hate speech, terrorism, false news, sexual activity, child abuse, promote use of intoxicants, self-injury of any sort, etc.
⦁ We accept the complete legal responsibility of the Content provided by us to Connecting NRIs. Connecting NRIs has no control over the Content and therefore it shall have no responsibility for the same.
⦁ Connecting NRIs shall be under no obligation to host or serve the Content.
⦁ If Connecting NRIs reasonably believes that the Content is in violation of the legal provisions including for example, copyright or trademark violations or other intellectual property misappropriation, impersonation, unlawful conduct, or harassment or may cause harm to it, its users, or third parties, it may at any time remove or take down the Content at its sole discretion and we shall have no objection to the same.
By providing Content to Connecting NRIs, we grant it a worldwide, non- exclusive, royalty-free, transferable, sub-licensable right to use the Content (including to reproduce, distribute, prepare derivative works, display and perform it).
Newsletter/ other fliers’ subscriptions
Visitors to this Platform may also sign up with their name and email address for a variety of newsletters/ information fliers’/ advertisement material that this Platform produces with varying frequency without having to register.

Your calls may be recorded to improve the service experience in the platform and for other business purposes. You hereby unconditionally authorize and / or approve Connecting NRIs to record the calls made by you to Connecting NRIs with respect to any services listed on this Platform. Connecting NRIs at its discretion may delete such recording shall from its database within a period of twelve (12) months or an earlier period at its sole discretion.
Further, by using Connecting NRIs services and providing us your number, while registering for an account or receiving alerts or contacting an advertiser seller / buyer/ tenant/ maintenance provider or other service provider, you:
⦁ Agree to receive a sales or service call from our employees / partner / alliances notwithstanding your registration for NDNC (National Do Not Call) registry.
⦁ Give consent to Connecting NRIs and its partners / vendors and sub-partners / sub-vendors to send alerts, contact details, SMS and calls related to User’s action in our website to the mobile number entered by the User, irrespective of whether the same is on the NDNC list or any other such data base.
In case the User does not want to receive these messages on his / her mobile number, he / she shall not submit his / her mobile number with this Platform.

Contacting businesses through this Platform
This Platform holds the rights to contact Users and Service Providers registered with the platform. The mode of contact may be through SMS / email / call, irrespective of whether the User is on the NDNC list or any other similar database.
You hereby waive your right to object and agree to not object and / or protest in relation to the same. All calls made to the User and the service provider shall be recorded by Connecting NRIs for training and quality purposes including dispute resolution, service assurance, and other business purposes of Connecting NRIs. You hereby give irrevocable consent to Connecting NRIs for sharing the call recordings to other third parties for business purposes of Connecting NRIs. You disclaim and / or abandon any right to sue and waive your right to object and agree to not object and / or protest in relation to any of these contact types.

Services Description:
Connecting NRIs attempts to be as accurate as possible. However, Connecting NRIs does not warrant that descriptions of or content of this site is accurate, complete, reliable, current, or error-free. Also, your access to the Services may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or at any time without prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction. Connecting NRIs provides links to other sites over which Connecting NRIs has no control. Connecting NRIs is not responsible for the availability of such external sites or resources and does not endorse and is not responsible or liable for any content, advertising, products or other material on or available from such sites or resources.

With respect to Ad servers: To try and bring you offers that are of interest to you, we have relationships with other companies to whom we allow to place ads on our Website and Mobile App. As a result of your visit to our Website and / or Mobile App, ad server companies may collect information such as your domain type, your IP address and clickstream information.

Mortgage services: If you request a mortgage quote using our services, you hereby consent and authorize us to share the personally identifiable information with financial institutions for the purpose of delivering such products and / or services. These institutions are not permitted to use the information for any other purpose.

User-Generated Content: If you use our user-generated content services, like posting a question, answer or blog on our Website and / or Mobile App, you should be aware that any personally identifiable information you submit there can be read, collected, or used by other users and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit in these forums. Further we are also not responsible for the comments or remarks posted by users in those forums etc. and therefore recommend you to perform your own diligence before relying on any such information.

Copyright and Trademark Policy: All content included in our Services, such as text, graphics, logos, button icons, images, clips, digital downloads, data compilations, and software, is the property of the Company, its Users and its content suppliers and protected by copyright laws. All software used on this Website and Mobile App is the property of the Company.
All other trademarks not owned by Company that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Connecting NRIs or its affiliates.

General Matters

Home Loan services: If you express interest for obtaining a home loan, you hereby consent and authorize us to share the personally identifiable information with financial institutions providing home loan products and/or services, and such financial institutions may call, email, or SMS you with reference to the home loan interest. This consent shall supersede any registration for any Do Not Call (DNC) / National Do Not Call (NDNC).
Indemnification and Limitation of Liability: Each User agrees to indemnify, defend and hold harmless the Company and its affiliates including but not limited to its (and its affiliates’) officers, directors, consultants, agents and employees (“Indemnities”) from and against any and all losses, liabilities, claims, damages, demands, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by the Indemnities that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by such User pursuant to these General Terms of Use. Further, each User agrees to hold the Indemnities harmless against any claims made by any third party due to, or arising out of, or in connection with, such User’s use of the Website or Services, User’s violation of the General Terms of Use, or User’s violation of any rights of another, including any intellectual property rights.
In no event shall the Indemnities, be liable to the Users or any third party for any special, incidental, indirect, consequential or punitive damages whatsoever, including those resulting from loss of use, data or profits, whether or not foreseeable or whether or not the Company has been advised of the possibility of such damages, arising out of or in connection with (i) User’s use of or access to the Website, Services or materials on the Website; or (ii) services provided by any Registered Service Provider.
The limitations and exclusions in this Section apply to the maximum extent permitted by applicable laws.

Amendment to the Terms of Service: We reserve the right, at our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to you. It is your responsibility to review these Terms of Use periodically for updates / changes. Your continued use of the Services following the posting of changes will mean that you accept and agree to the revisions.

Grievance Redressal Mechanism: Any complaints, abuse or concerns with regards to content and or comment or breach of these terms shall be immediately informed to the Grievance Officer through email. Any grievance so received by the Company shall be resolved within the best possible time.

Arbitration: If any dispute arises between a user/users and Connecting NRIs arising out of use of the Website or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of these terms and conditions, the dispute shall be referred to a sole Arbitrator who shall be an independent and neutral third party identified by Connecting NRIs. Decision of the Arbitrator shall be final and binding on both the parties to the dispute. The Arbitration & Conciliation Act, 1996 or any subsequent amendments to it, shall govern the arbitration proceedings.
